P1Mitigators™
Full Insurance Contractor Terms
We support the Contractor as well as the Homeowner.
P1Mitigators™ acts as the Contractor's administrative Project Coordinator — documentation, estimates, billing, tracking and lien releases.
We set up the project to be funded by the insurance carrier, paid out by the homeowner, and performed by the contractor.
The homeowner signs their own coordination addendum, which helps make sure the Contractor (and P1Mitigators™) are paid.
This agreement is between P1Mitigators™ and the Contractor listed above and signing below.
Parties
This Project Coordination Services Agreement is between P1Mitigators™ ("Project Coordinator") and the Contractor named above ("Contractor").
It covers the insurance project identified by the Project# above, and any other project P1Mitigators™ assigns to the Contractor.
The homeowner is NOT a party to this agreement.
The homeowner signs their own Project Coordination Agreement.
1. Appointment & Scope
Contractor appoints P1Mitigators™ as an independent administrative Project Coordinator for residential construction projects.
P1Mitigators™ is an independent contractor to the Contractor — not an employee, partner, or agent of the insurance carrier.
P1Mitigators™'s administrative scope includes, but is not limited to:
• Compiling multi-point damage documentation (photos, video, measurements).
• Preparing line-item repair estimates (Xactimate).
• Managing tracking logistics and administrative milestones.
• Mediating billing and collection processes.
• Getting the Contractor paid from all levels of the claim payout:
– ACV: the initial payment / deposit to start the work.
– Recoverable Depreciation (RD): funds withheld until the work is proven completed.
– Supplements: additional money needed beyond the original estimate, if accepted and paid by the insurance carrier.
• Checking in to confirm the job is on track—not overseeing the job or its work processes.
• Enforcing the collection of lien releases.
2. Limitation of Authority (UPPA Compliance)
P1Mitigators™ is strictly an administrative coordinator—not a construction supervisor.
P1Mitigators™ does not oversee the job, its work processes, or how the Contractor performs the work; we only check in to make sure things are on track.
P1Mitigators™ shall not interpret insurance policy language, advise homeowners on legal policy rights, or negotiate final claim settlements with insurance carriers.
All discussions of physical damage scope, quantities and repair methods are performed strictly under the umbrella of the Contractor's valid Florida construction license.
• P1Mitigators™ is not a public adjuster, collection agency, or law firm / attorney.
• Only a licensed Public Adjuster or an Attorney can "negotiate" an insurance claim.
3. Compensation & Fee Structure — 10%*
In consideration for the administrative and field services rendered, the Contractor pays P1Mitigators™ as follows:
• Completed & Funded Project: 10% of the gross insurance settlement / contract total — ACV, Recoverable Depreciation (RD), Supplements and Overhead & Profit (O&P).
Due within 5 business days of the Contractor receiving each insurance draw, including the final draw.
• Homeowner Cancellation Fee (if / only collected): 10% of any cancellation or liquidated damages fee the Contractor collects.
Due within 5 business days of the Contractor collecting the fee.
Insurance checks may be issued to the homeowner, to the Contractor, or to both — the fee is owed either way.
* When the insurance carrier simply will not budge, P1Mitigators™ will consider lowering its %.
P1Mitigators™ will not accept any insurance claim offer without the approval of each trade contractor.
The Contractor has the full right to refuse any job with an insufficient Replacement Cost Payout, with no fees owed to P1Mitigators™ for declining that job.
The Contractor sets its own down-payment terms with the homeowner and may wait to start work until those deposit terms are met.
4. Exclusivity & Non-Circumvention
All files assigned to the Contractor by P1Mitigators™ are proprietary.
The Contractor shall not bypass, circumvent, or directly contract with any homeowner introduced by P1Mitigators™ to avoid paying the agreed project management fees.
Insurance Proceeds — How the Contractor Gets Paid
Insurance Proceeds for each contractor are the total of each trade that contractor completes, under RCV (Replacement Cash Value) on the carrier's payout sheet.
That RCV amount is paid to the Contractor, minus the 10% P1Mitigators™ fee (in some cases the homeowner may pay the 10% to P1Mitigators™ directly).
Example: If you completed drywall work or tree removal, the carrier’s payout sheet totals the RCV for that trade’s work.
That total is your money as the Contractor for that work.
You then pay P1Mitigators™ the 10% fee, unless the homeowner has already paid that fee directly to P1Mitigators™.
P1Mitigators™ also seeks the additional 10% Overhead and 10% Profit (O&P) on each job, which is included in the total RCV.
RD is money the carrier holds back until the job is proven completed — it is also paid to the Contractor (minus our fee).
Homeowners are made aware of any Supplement or RD money released, and that they must pay it out to the contractors performing the work.
P1Mitigators™ Works for the Contractor Too
We set up the proper Work Authorizations and Contingency Agreements that allow us to bill insurance carriers directly.
• Educate and confirm the Homeowner(s) understand that insurance funds allocated to the contractors’ work are not their money to keep — that money is owed to the contractors for the work.
• Help collect new, due or overdue payments — from the 1st payment, to the supplement, to the final payout — from the homeowner or insurance carrier.
• Send Notices to Owner (pre-lien notices) and start any lien process if needed — free of charge.
* P1Mitigators™ follows Florida lien laws and statutes, using 3rd-party legal entities.
Lien Releases
The Contractor provides fully executed partial and final lien releases (Florida Statute § 713.06) as draws are paid.
A final lien release waives any rights to further pursue payment from the jobsite / homeowner.
* NO final payout is made to the Contractor until a signed final Lien Release is received.
Photos & Receipts
The Contractor agrees to upload pictures of their trade work and their trade receipts to this job folder, using the upload box on this page.
Photos and receipts support the claim, supplements and Recoverable Depreciation release.
Payments to the Contractor
The Contractor selects their preferred payment method below.
Insurance & Business Documents
The Contractor keeps General Liability Insurance (COI), Workers' Comp (or a valid exemption), and their registered Business Name (Sunbiz / DBA) uploaded and current on their P1Mitigators™ Contractor Profile.
A State / Trade License and W-9 are also requested where they apply.
The Contractor is an independent business and is solely responsible for their own insurance, licensing and workers.

I will not bypass or directly contract with any homeowner introduced by P1Mitigators™ to avoid these fees.

I will upload my trade photos and receipts to this job folder.
I will keep my General Liability (COI), Workers' Comp (or exemption) and Business Name registration uploaded and current on my Contractor Profile.
